The Copyright Licensing Agency (CLA)

This is an agreement entered into and paid annually by Children's Services on behalf of schools. It is a licence to copy, within clearly defined limits from books, journals and magazines published in the UK, Ireland, Finland, France, Germany, Norway, Iceland, Denmark, Spain, Sweden, Australia, Canada, New Zealand, South Africa, The Netherlands, Switzerland (including Liechtenstein and the USA.   The main limitations are:
 
For each individual class, lesson or course of study in one academic year;
 
  • The copying of up 5% or one complete chapter not exceeding 30 pages (whichever is the greater) from a book or
 
  • Up to 5% or one article not exceeding 30 pages (whichever is the greater) from a journal or periodical or
 
  • A short story or poem not exceeding 10 pages in length published in the above listed countries
The licence does not cover
 
All items on the Excluded Works and Categories List as well as the following specific categories:
 
  • Maps, charts or books of tables
    • You may copy any OS mapping you have purchased for internal school requirements. The copy must carry the followingOS acknowledgement:-
 
    • “This map is reproduced from Ordnance Survey material with the permission of Ordnance Survey on behalf of the Controller of Her Majesty’s Stationery Office Crown Copyright. Unauthorised reproduction infringes Crown Copyright and may lead to prosecution or civil proceedings. Norfolk County Council. Licence No 076759 (followed by the year).
 
    • Other maps etc. the copyright holder should be contacted for permission to copy.
  • Newspapers
    • A licence for copying from UK national and regional newspaper is available from the Newspaper Licensing Agency. (tel.01892 525275)
 
  • Printed music including the words
    • Teachers should consult the Music Publishers Association (tel. 0207839 7779)
 
  • Hymns, bibles, prayerbooks and orders of service
    • Words of hymns where the lyrics are out of copyright but the typographical arrangements is still in copyright may be retyped and the photocopied. A Christian Copyright Licence permits the making of transparencies, songbooks, and weekly service sheets where the lyrics are still in copyright. (tel.01323 417711)
    • NOTE bibles, liturgical works and order of service removed from Excluded material 12/2/03
 
  • Examination and test papers
    • Examination boards should be asked for permission prior to copying
 
  • Correspondence courses
    • Works published by the Open University and National Extension College may be copied under the licence, those from other organisations may not.
 
  • Publications which specifically say they are not to be copied under the CLA licence
 
  • Artistic works (including photographs illustrations and diagrams)
  • Workbooks, workcards or assignment sheets
    • Defined as publications intended for pupils to write on and for once only use.
 
  • Privately prepared teaching material
 
  • Publications on the Excluded Works list include
    • BBC periodical and magazines (BBC books are covered by the licence)
    • ITV publications – all publications
    • Encyclopaedia Britannica – all publications
    • Readers Digest Association – all publications
    • Robert Gibson & Sons – all publications
    • JM Dent & Sons Ltd – all works by Dylan Thomas
 
Teachers wishing to copy from any of the publications on the Excluded List should contact the publishers for prior permission, alternatively they may make multiple copies of up to 1% of the work for educational purposes in any one quarter (i.e. 1st January to 31st March, etc) or take a single copy of up to 5% for research or private study under the ‘fair dealing’ provision of the Copyright Act.
 
 The school is licensed to make enlarged or reduced photocopies of up to the whole book or journal for use by visually-impaired pupils or teaching staff. Provided that at least one copy of the original material has been purchased by the school. The licensed material is not already available in large print format. That the number of copies does not exceed the number required for the purpose of instruction.
 
There is no requirement to log copying of copyright material under the Licence. However, each year two Norfolk schools are nominated by the CLA to keep a detailed record of their copying. (If a school would have difficulty in being a nominated school such as an impending Ofsted inspection, Children's Services can request that another school be nominated). Also a school may be selected to take part in a 30-day survey by the CLA in which they provide details of the copies made during that period.
 
In coming to this agreement Children's Services had to agree that:
 
a)                 it would nominate a Licensing Co-ordinator who will be responsible for copyright compliance in Children's Services schools; that person is Mick Sabec, Head of Business and Efficiency.
 
b)         every school would nominate a person (a Copyright Compliance Officer) to be responsible for monitoring that control systems operate
            satisfactorily and to work with the Children's Services Officer above.
